Former UFC fighters detail struggles in letters supporting proposed antitrust settlement

From TBI to mental health hospitalizations to debilitating injuries, 50+ former UFC fighters revealed why they need settlement payout

More than 50 former UFC fighters submitted letters of support for the proposed $375 million settlement agreement in the Le vs. Zuffa antitrust class-action lawsuit.

According to online records, the letters were filed Monday by plaintiffs as part of a memorandum in support of settling. The letters come 12 days after the agreement proposal was filed Sept. 26. News of the filings was first reported by journalist John Nash.

The proposed $375 million settlement comes less than two months after U.S. District Court judge Richard Boulware denied an initial proposal of $335 million, which also included Johnson vs. Zuffa under its umbrella. The current proposal is strictly for Le vs. Zuffa.

The letters

Many fighters who wrote letters painted a grim picture of life after fighting.  Reoccurring themes include financial struggles, physical injuries, brain trauma concerns, and mental health problems. The fighters reiterated their preference for immediate financial relief rather than risk the outcome of a trial, which could benefit the fighters more lucratively or leave them with nothing.

“For me, a significant recovery in the near future is much more appealing than the possibility of a larger recovery several years from now, especially in light of the possibility that there would be no recovery at all if this settlement were not approved,” each letter read. “In my situation, a bird in the hand truly does beat two (or three, or even nine) in the bush.”

Among the most notable names is UFC Hall of Famer [autotag]Wanderlei Silva[/autotag], who stated concerns for traumatic brain injury (TBI) and chronic traumatic encephalopathy (CTE).

“While fighting for the UFC, I suffered many significant injuries, including concussions,” Silva wrote. “I fear that during my career I have suffered traumatic brain injury (TBI) and am noticing symptoms common with TBI and CTE including depression, mood swings, and irritability. To date, no treatment for CTE has been found. I suffer from sleep apnea and have difficulty sleeping and breathing.”

“The Ultimate Fighter, Season 1” winner [autotag]Diego Sanchez[/autotag] voiced similar worries about his health, including bouts of depression, and financial problems after his UFC career concluded.

“Increasingly, day to day survival is a struggle,” Sanchez wrote.

UFC heavyweight [autotag]Todd Duffee[/autotag] recalled 16 surgeries he had during his career but went into greater detail about the narrative he said the promotion crafted around him, likely referring to 2010 comments made by Dana White.

“Picture yourself at 25 in the most important job interview of your life,” Duffee wrote. “To have the interviewer question why your former employer at a fighting organization, believes you to have a bad attitude and to announce it is publicly causing them to express concern over this characterization— simply because you refused to fight while injured for a second time in a row after previously competing with a torn MCL and shingles in your eye.

“I am sure you can see how this mischaracterization has had quite an economic impact moving through my life. It has continued to haunt me and is weaponized against me in all kinds of business job settings stifling my potential for many opportunities.”

Shane Carwin

Former UFC interim heavyweight champion [autotag]Shane Carwin[/autotag] said he still struggles from the damage sustained during his six-fight stint with the promotion and can no longer focus on his day job.

“Cognitive tests conducted at the Cleveland Clinic Lou Ruvo Center for
Brain Health and Concussion Legacy Foundation at Boston University (among others) are indicating I have suffered damage to the pre-frontal cortex and left hemisphere,” Carwin wrote. “I spend days in bed suffering from bouts of paranoia, fear and anxiety.”

The list of other notables who submitted letters include [autotag]Matt Brown[/autotag], [autotag]Patrick Cote[/autotag], [autotag]Jon Fitch[/autotag], [autotag]Cung Le[/autotag], [autotag]Sage Northcutt[/autotag], and [autotag]Cat Zingano[/autotag], among others.

What does the settlement look like?

According to the recent filing, the total sum allotted to the plaintiffs (should Boulware approve) would be $375 million and would be paid in installments.

According to the proposed notice of class action settlement, each fighter’s payout will depend on two factors: the number of fights they had and the amount of money they earned from the UFC during the class window.

“The proposed Plan of Allocation can be summarized as follows,” the notice states. “Each Claimant will be allocated his or her share of the Net Le v. Zuffa Settlement Fund based upon two pro rata factors: (i) the total compensation each received from the UFC for participating in UFC bouts (i.e., the fighter’s Event Compensation) during the Class Period; and (ii) the total number of UFC bouts each fought during the Class Period. All Claimants will receive a minimum recovery amount of $15,000.”

What’s next?

Upon receiving the previous settlement proposal, Boulware denied it based on factors, including what he perceived to be a low payout, particularly given the initial asking amount by the plaintiffs.

It’s not yet known if Boulware will sign off on the new agreement. If Boulware denies the settlement and the case goes to trial, plaintiffs would need a unanimous jury verdict to win. Even with victory, the plaintiffs could be looking at years worth of appeals before seeing compensation.

Should Boulware approve this new agreement, the Johnson vs. Zuffa case will continue separately. The class in that case includes all fighters who competed in one UFC bout from July 1, 2017, to the present and seeks injunctive relief.

BKFC KnuckleMania 4 results: Disappointed Ben Rothwell claims quick injury TKO win over Todd Duffee

It goes down as a victory for Ben Rothwell, but his anticipated BKFC KnuckleMania 4 showdown with Todd Duffee wasn’t what he wanted.

LOS ANGELES – It goes down as a victory for [autotag]Ben Rothwell[/autotag], but Saturday’s anticipated BKFC KnuckleMania 4 showdown with [autotag]Todd Duffee[/autotag] wasn’t what he wanted.

Rothwell (3-0) and fellow former UFC heavyweight Duffee (0-1) came out firing after the opening bell, with Rothwell knocking down Duffee twice in the first 0:43 seconds of their bout at Peacock Theater. The second time proved to be the finish as Duffee suffered an apparent right shoulder injury when he fell to the canvas. He immediately pointed to it, forcing referee Dan Miragliota to wave off the fight.

Rothwell, whom Duffee laid into verbally after he fell ill and pulled out of their originally scheduled bout last December, expressed his frustration afterward.

“No, I came here to knock him the f*ck out for all of you,” Rothwell said during his post-fight interview. “He clipped my nose, and I was about to get my payback. He got hit the first time he got knocked down, and the fight was already over there. I just needed to get one good connection, and this would’ve been a good, clean knockout. I can’t control my opponent.

I’m sorry to everybody, man. I came here to perform. You can see the work I put in. I came here to get myself into a title fight.”

Whether or not that’ll happen after a victory earned because of an injury remains to be seen, but Rothwell took his shot on microphone.

“Of course, (a title shot) is what I want,” Rothwell said. “But the performance got taken away from me just now. I think everybody knows what I’m about and what I was going to do. Thank you. The fans of BKFC know because I’m fighting for all of you. I’m going to get that belt. I’m going to go in there and sign every autograph and take every photo I can with all of you. This is what I do it for.”

In addition to a disappointment for Rothwell through no fault of his own, the fight was even more so for Duffee, whose return to MMA after a four-year hiatus didn’t go well last year as he lost by first-round TKO to KSW champion Phil De Fries in February 2023. Now he’s followed that up with an unfortunate injury defeat in his BKFC debut.

Todd Duffee interested in fighting Francis Ngannou in PFL: ‘Please sign me up for that fight’

Todd Duffee is interested in fighting Francis Ngannou in MMA.

MMA veteran [autotag]Todd Duffee[/autotag] likes what the PFL is doing in the sport so much that he wouldn’t mind being a part of it.

Duffee is particularly interested in PFL’s signing of former UFC heavyweight champion [autotag]Francis Ngannou[/autotag], who left the UFC as champion after he fought out his contract in an unprecedented free agency move.

Duffee would love to be the first opponent for Ngannou under the PFL umbrella, and he doesn’t see it as something impossible.

“Oh, yeah, I’d love to, and I think they would give me that opportunity, too,” Duffee told MMA Junkie Radio when asked about a potential fight against Ngannou. “I would love to do that. It’s a fun, exciting fight.

“I do think they have a lot of sexy matchups, but I love heavyweight fights, so maybe I see it differently. Both guys that fought last weekend would be amazing matchups for him. I think that in general, PFL has a good roster of heavyweights I would love to see Francis fight. But yeah, please sign me up for that fight. Everybody wants that fight.”

Duffee was scheduled to return to action this Saturday in the co-main event of BKFC 56 in Colorado. However, his opponent and fellow former UFC heavyweight Ben Rothwell was forced out due to illness, and the fight is to be rescheduled for February.

Even if the Ngannou offer doesn’t come his way, Duffee would still be interested in fighting for the PFL.

“The tournament is the best because you know it doesn’t matter if you’re hurt and stuff like that, even that gets removed from your head a lot easier,” Duffee said. “I think tournaments are the coolest thing, for sure. If you can fight month after month, it’s the most beautiful thing in a guys’ career.”

Ben Rothwell out of BKFC 56, fight with Todd Duffee now targeted for February

BKFC 56 has lost its original co-main event after Ben Rothwell was forced to withdraw because of illness.

BKFC 56 has taken a hit.

The co-main event between [autotag]Ben Rothwell[/autotag] and [autotag]Todd Duffee[/autotag] has been postponed after Rothwell came down with an illness, BKFC president David Feldman announced Thursday at the BKFC 56 news conference.

“Ben Rothwell actually came down really, really sick this morning, and he’s not going to be able to compete,” Feldman said. “We tried to get a last-minute replacement for Todd Duffee, and we just couldn’t line it up, so we’re going to push that for February. Sorry to the fans for that one, but we still have a stacked card.”

Duffee, who still attended the BKFC 56 news conference, wasn’t happy with the development and took a shot at Rothwell for withdrawing.

“I fought with COVID my last fight, so I really think Ben’s real fight is happening with the scale,” Duffee said. “I think Thanksgiving was his biggest opponent. I don’t know what else to really add to that. Again, I fought with COVID, I understand what it’s like, but you make a commitment, you try to get out there and make it happen. I don’t think Ben by any means is a weak man. Maybe he’s going through something I don’t understand, but I think his biggest fight was Thanksgiving. And I think that’s where he lost.”

This was supposed to be Duffee’s debut in bareknuckle boxing, but now he’ll have to wait until the first quarter of next year. Rothwell was set to make his third BKFC appearance since his UFC departure in March 2022. Rothwell is 2-0 in bareknuckle.
