Adam Silver can’t just tell us suspended Suns owner Robert Sarver has ‘evolved.’ He has to prove it.

Adam Silver should tell us about the context we are missing.

NBA commissioner Adam Silver held a press conference on Wednesday, which was his first public address since Phoenix Suns owner Robert Sarver was fined and suspended for violating workplace standards.

Many fans were surprised that Sarver was not ousted from the league like former Clippers owner Donald Sterling. As my colleague Prince Grimes wrote, the punishment was way too lenient. NBA stars, including LeBron James, have emphasized this point.

Silver told reporters that he was in “disbelief” and “disheartened” when he discovered what transpired within the Suns organization. He stated that the conduct was indefensible.

As noted by Sean Highkin and Jonathan Feigen, Silver emphasized the transparency of the report — which you can read in its entirety here.

But the commissioner also mentioned that the league’s punishment was based on the “totality” of the circumstances, which included information not issued to the public due to confidentiality.

“I have access to information that the public doesn’t, and again, I’m able to look at the totality of the circumstances around those events in a way that we’re not able to completely bring to life the nuance that you see when you read a report or deal with it sort of in short bursts of news reporting.

“Differentiating between the facts in this situation and Donald Sterling, is the context. I have available to me more of a context than the public can, and that’s just the nature of it, because we have investigators who then can explain what they learned in 320 interviews and say, for example, the person was there and heard those words but this is how they interpreted them in that context. In the case of Sterling, we all could make our own judgments.

“Remember, while there were these terrible things, there were also many, many people who had very positive things to say about him through this process. Ultimately, I took all of that into account in making the decision that the one-year suspension plus the fine was appropriate.

“I think what your litany leaves out are many very positive things he did, as well, and also leaves out how those events were characterized by those people who were directly involved in them and how they described them to the investigators.”

According to Silver, “much of the behavior” outlined in the findings occurred “much earlier” in his ownership tenure. He added that what the litany leaves out are the “many very positive things” that Sarver has done.

During the press conference, Silver boldly stated that Sarver “clearly has evolved as a person” during his time with the organization.

But what does that mean? What are we missing that Silver is alluding to but won’t actually say? It is almost impossible to imagine anything that could make Sarver’s actions any more permissible, but if Silver has such a thing, then what is it?

Within the report, Sarver told investigators that he has made “substantial personal and professional contributions” to social and racial justice causes.

His attorney, Thomas Clare, celebrated the “longstanding commitment to diversity, equity, inclusion, and social justice” that Sarver has displayed. Clare argued Sarver has “proven time and time again” that he is a “tireless advocate” for social justice.

But the findings of the report paint a different picture, far more damning.

For example, as early as 2004, Sarver was “made aware” that he should not use racial slurs. Yet the report indicated that Sarver’s ugly pattern of behavior then continued until at least 2017.

That lack of discretion, as you can read below, included an instance in which he emailed the league office using the slur as recently as October 2016:

“The investigation finds that Sarver said the N-word in repeating or purporting to repeat what a Black person said: (1) during a 2004 meeting to recruit a free agent player; (2) during a 2012 or 2013 Suns team-building exercise in Phoenix; (3) after the Suns’ October 30, 2016 game against the Golden State Warriors; and (4) at least twice between 2010 and 2017 in recounting an incident involving a player’s family member. As early as 2004, Sarver was made aware that he should not use the N-word even when repeating another person’s use of it.”

Sarver also had “confrontations with Black coaches” as recently as 2019.

Silver stated that in order to understand the context of the language used, individuals have to understand the “totality of circumstances” (a phrase that the commissioner repeated six times during the press conference) to interpret the motivations.

Additionally, the report found Sarver’s behavior toward women was both inequitable and demeaning. Meanwhile, examples of Sarver’s crude and vulgar commentary regarding sex occurred as recently as 2021.

This hardly suggests that Sarver is the “evolved” person that Silver had characterized him as during the press conference.

So what is the difference between Sarver and Sterling, the former Clippers owner? Silver stated that there was a “realism” to Sterling’s actions due to the audio recording:

“I think it was more the nature of how we learned about it, how the public was aware of it in a time where — the way it was disseminated so quickly over the internet. I think there was a realism to it that exists when you have audio of something that put — back to my earlier comments, put everyone in essence in the same position I was in. We were all looking at the same record, anyone who cared to listen to Donald Sterling’s words.”

As noted by Brendon Kleen, however, TrueHoop’s Henry Abbot obtained a video of Sarver making vulgar, inappropriate comments at a funeral (!!!) in April 2021.

Meanwhile, ESPN’s Baxter Holmes reported that in May 2022, a female Suns employee resigned due to toxic and misogynistic workplace culture.

She alleged that the organization had “never been more dysfunctional” and that the culture of the team is “rapidly eroding” to the point that it had finally become intolerable.

Let’s take a step back and process that for a moment. Just a few months ago, someone who worked for the team since 2014 stated that Sarver’s workplace had never been worse than it was in this season.

Silver argued that Sterling displayed “blatant racist conduct” directed at a “select group of people” before he sold the Clippers in 2014. Sarver may not have directed his actions towards a specific group, but there is quite a bit of evidence that he showed indefensible behavior.

If the commissioner has evidence that Sarver has actually evolved, and that there is some necessary context that the public is missing, then now would surely be a good time for that to come to light.

Public pressure on Sarver, as well as the NBA regarding Sarver, has come nowhere close to Sterling levels — presumably because there is no TMZ recording, as with Sterling, of Sarver’s misdeeds. LeBron James blasts NBA response to Robert Sarver: ‘No place in the league for this kind of behavior’

The face of the NBA did not mince his words.

The NBA announced its findings and punishment for Phoenix Suns and Mercury owner Robert Sarver earlier this week, with the league concluding that Sarver was responsible for “workplace misconduct and organizational deficiencies” in his 17 years with Phoenix.

The NBA issued Sarver a one-year suspension where he can’t be around any league facilities or events. They also levied a $10 million fine. (Here’s more on the Sarver fallout from USA TODAY.)

Given Sarver’s history of harassment, racism and misogyny, much of the NBA world thought Sarver’s punishment was far too lenient. Especially with a similar precedent already established by former Clippers owner Donald Sterling, who was forced to sell the team in 2014 after a lifetime ban.

On Wednesday, LeBron James was one of the first NBA players to publicly condemn Sarver’s actions while blasting league leadership for getting their response wrong:

Those are strong remarks from the face of the NBA. Perhaps with James taking it upon himself to issue a public statement about Sarver’s punishment, it might open the door for more players and NBA figures to critique the league’s response.

NBA’s 1-year suspension of Suns owner Robert Sarver was way too lenient

Donald Sterling’s lifetime ban should have set a precedent.

On April 29, 2014, the NBA issued a lifetime ban of former Los Angeles Clippers governor Donald Sterling for racist comments he made that were caught on an audio recording. The ban precipitated his eventual forced sale of the Clippers, which required a three-quarters majority vote by the other team owners.

On the recording, Sterling was upset with girlfriend V. Stiviano for sharing a photo of herself with Magic Johnson on Instagram, urging that she not post photos with Black people. Eight years later, his punishment was thought to set a precedent for how the NBA would handle Phoenix Suns governor Robert Sarver, who was accused in reports last year of creating a hostile work environment through racism, misogyny and harsh treatment of employees over his 17-year tenure.

Instead, what happened Tuesday fell well short of those expectations. The NBA announced that Sarver was being suspended for just one year and fined $10 million. Commissioner Adam Silver said Sarver’s racist comments were “beyond the pale” but “wholly of a different kind,” whatever that means. Fans were displeased, believing another ousting was in order.

Personally, I’m not as concerned about whether or not they removed him as owner. I do think the precedent was there to do so, but a forced sale is hardly punishment when it nets him upward of a billion dollars. I do, however, believe a one-year ban was extremely too lenient.

The NBA’s investigation found that Sarver “clearly violated” workplace standards. He used a racist slur at least five times, and there were instances of inequitable conduct toward female employees. As isolated incidents go, his transgressions were actually worse than Sterling’s because they happened at the actual workplace, involving people he employees.

Of course, anyone who’s read about Sterling’s past transgressions knows they run deeper than just the comments about Johnson. And the audio recording likely made a legal battle more possible to win. But even if the league didn’t feel it could win in court against Sarver, why didn’t it issue a similar lifetime ban? How did it land on a ban that allows someone who displayed such foul behavior to return after just a year?

This was a rare miss for the NBA.

My colleague Bryan Kalbrosky couldn’t help but wonder how Wagner’s ever-evolving skillset will mesh with the top pick of this year’s draft, Paolo Banchero.

“This excellent performance was nothing new for Wagner, who scored 32 points against Lithuania on Sept. 4. He was 4-for-7 from beyond the arc.

I was most impressed with Wagner against Sweden during the FIBA World Cup European Qualifiers on August 25. He recorded 16 points but added 5 assists, 5 rebounds, 2 blocks, and 2 steals. It was the perfect display of his utility.

Wagner is finishing a large share of his offensive possessions as the ball-handler in pick and roll sets, per Synergy. Only two players have been more efficient when shooting off the bounce. Combine that skill set with rookie teammate Paolo Banchero, and the Magic may have the best blend of height and creation skills of any young frontcourt in the NBA.”

NBA fans think Suns owner Robert Sarver should be ousted like former Clippers owner Donald Sterling

This wasn’t enough.

The NBA announced the findings and punishment following the investigation of Phoenix Suns and Mercury owner Robert Sarver.

After interviews with 320 people and an evaluation of more than 80,000 documents, per The Athletic’s Shams Charania, Sarver was found guilty of “workplace misconduct and organizational deficiencies” during his 17-year tenure as a team owner.

Sarver was issued a one-year suspension and he cannot be in an NBA facility or attend any league events during that time. He will also pay a $10 million fine (the maximum amount that the league is allowed to hand out), which will then be given to organizations that address “race and gender-based issues” in the workplace.

While both punishments are notable, many NBA fans felt that the league did not go far enough. The league issued a lifetime ban on former L.A. Clippers owner Donald Sterling in 2014, and several individuals wondered why those same measures were not taken against Sarver.

The Phoenix Suns today signed guard Devin Booker to a contract extension. “Devin has had a truly special impact on our organization, our fanbase and the Valley community since he first arrived in Phoenix,” said Managing Partner Robert Sarver. “We are grateful for all his contributions and we are thrilled to ensure that he will remain in a Phoenix Suns uniform into the future.”

Have you had any interaction with Sarver since you came out? Ryan Resch: I hadn’t seen him or had a chance to talk to him in person for a few months after I came [out] to James and the rest of the organization. My then-boyfriend had been coming to games during that period. When I told Robert a couple of weeks ago, he was amazing. He told me, “I’m so happy you feel comfortable enough to live as who you are, and bring someone special to you to a game.” We spoke about Rick Welts. The best part of the conversation was our discussion about how it’s the quality of the work that will determine my trajectory professionally in the franchise. It’s about merit.
