Plaintiff’s attorney issues statement on Bills’ release of Matt Araiza

Statement by ‘Jane Doe’ attorney on #Bills’ release of Matt Araiza:

Following the Buffalo Bills’ decision to release punter Matt Araiza over the weekend, representatives for the teenager accusing him of gang-raping her released a statement.

In it, attorney Dan Gilleon says Araiza should have already been released by the time he actually was.

Prior to being cut, Araiza also made a statement that proclaimed his innocence.

The full statement was posted to Gilleon’s social media and can be found below:

“The Buffalo Bills had no choice but to cut their young punter after so badly botching their response to our claim: they ignored us, as though what I warned them would happen could be avoided if they just kept their heads in the sand. This is what enablers do.

My client’s life was forever scarred in October 2021, but she handled herself with grace and dignity. Not once did she express to me a desire to hurt her assaulters out of revenge or hatred. She never asked for a pound of flesh. Her only ask was the kind of justice that might save other young women from the hell she experienced.

When she authorized me to contact Matt Araiza and the other defendants, she made it clear that money was not her aim. She never asked for a dime from Matt Araiza. Mr. Araiza’s attorney knew that. He knew that he had offered us money to settle the case and that we had rejected the offer. Yet, Mr. Araiza’s legal counsel had the audacity to go on a despicable, brainless tv tour to defame my client as a ‘shakedown’ artist and ‘money grabber.’ Think about that. Mr. Araiza’s legal agent knew that a 17-year-old girl had left a room where Matt Araiza was also present, covered in blood and bruises and crying that she had been raped. Yet, he stooped so low that he was willing to label that the 17-year-old girl an opportunistic grifter. This was utterly inhumane and stunningly foolish. If Matt Araiza had shown 1% of the grace that my client has, perhaps by offering an apology and donation his money to a charity serving rape survivors, he would still be a Buffalo Bill and his parents could sit in the stands and watch their son with pride. Instead, he decided to hire an attorney who knew only to viciously attack the young woman his client had raped. Now Mr. Araiza’s life is forever scarred too. Perhaps this is the self-inflicted justice he deserves.”

Bills’ Mitch Morse on Matt Araiza lawsuit: ‘Shock at first’

#Bills’ Mitch Morse on Matt Araiza lawsuit: ‘Shock at first’

Many around western New York and the NFL world were shaken when punter Matt Araiza was accused in a gang-rape lawsuit.

Now former teammates of Araiza were no different.

On Monday, Bills players spoke to reporters in the locker room for the first time since everything unfolded. Buffalo visited the Carolina Panthers before Araiza was officially released, but in wake of the entire situation, only backup quarterback Matt Barkley spoke via press conference.

Barkley, who punted during the contest, didn’t–and really couldn’t–open up much. He said the Bills were focused on the task at hand… or at least the best they could.

With the dust settled, some candid answers were provided by offensive linemen Mitch Morse and Dion Dawkins.

Morse said he thinks the front office made the “right decision.” He added he knows it still was not an easy one.

“That’s why I’m the player. And they’re the guys that have to make those decisions,” Morse said via the Buffalo News. “So a lot of kudos for them making the decision that they thought was right.”

Dawkins already tried to put it behind him. What’s done is done, he said.

But Dawkins knows it’s not a situation anyone could take lightly.

“It’s hard, you know, because I have three kids,” Dawkins said. “I have two girls and a son. Anytime where anything happens like as a guy, like, you get just that thought like ‘Damn, I’ve got kids. I’ve got sisters, I’ve got moms, I’ve got daughters.’ You never know.”

“The thoughts always come, but you’ve just got to try to keep your mind right and not think about stuff that you really can’t control,” Dawkins added.

Brandon Beane: Bills, NFL didn’t know about Matt Araiza’s rape accusation before draft

Bills GM Brandon Beane says the team and the NFL didn’t know about Matt Araiza’s rape accusation before the draft

The Buffalo Bills made the decision to release rookie punter Matt Araiza on Saturday night after he was accused in a gang-rape lawsuit from his time at San Diego State. General manager Brandon Beane told reporters during a press conference that the team is still piecing together details from the allegations and attempting to find out what happened.

But given the circumstances, the Bills decided to cut Araiza and let him “go handle his situation.”

There were questions about whether the Bills knew about these accusations before the draft when they selected him in the sixth round – later than many expected Araiza to be drafted. Beane cleared things up Saturday by telling reporters that the team did not know about it, nor did the league.

Beane also said the Bills reached out to more than 10 teams, and none of them knew about the accusations.

Pre-draft, Araiza was viewed as the best punter in the class, with some projecting him to go as early as the third or fourth round. He slipped to the sixth and wasn’t even the first – or second – punter drafted.

Now with Araiza being released, the Bills don’t have a punter on the 80-man roster.

Buffalo Bills release punter Matt Araiza in wake of gang-rape lawsuit

The Buffalo Bills released punter Matt Araiza in the wake of the gang-rape lawsuit filed against him and two other San Diego State players.

On Saturday afternoon, the Buffalo Bills announced the release of rookie punter Matt Araiza. The release of a punter isn’t generally news, but in this case, it certainly is, and the only question is what took the Bills so long to do it.

A report by Colleen Shalby and Robert J. Lopez of the Los Angeles Times revealed that Araiza is one of three current and former San Diego State players named in a San Diego County Superior Court lawsuit. An unidentified woman claims that Araiza, Zavier Leonard and Nowlin “Pa’a” Ewaliko took turns having non-consensual sex with her as she went in and out of consciousness. The woman was a 17-year-old high-school senior at the time.

The Araiza situation was a horrible look for the Bills from start to finish, and the team’s handling of it sadly mirrored the generally cavalier attitude the league and its member clubs have about any kind of violence against women. The Bills originally said in a Thursday statement after the Times report came out that the team had done a “thorough investigation” of the matter, and nothing could have been further from the truth.

A source with information about the situation told Tim Graham of The Athletic that while the Bills were not aware of the alleged incident when they sleeted Araiza in the sixth round of the 2022 draft, they were aware when they cut punter Matt Haack last Monday, making Araiza the starter by default.

From Graham’s story:

The accuser’s attorney told The Athletic on Friday morning the Bills never reached out to him or his client after an initial conversation with the team’s counsel.

“Absolutely not,” attorney Dan Gilleon said. “Never heard from them again.”

After an introductory email to Bills assistant general counsel Kathryn D’Angelo on July 31, Gilleon said the next day he had “a long phone call” with D’Angelo but has had no further contact with the club.

The Bills have not responded to a request for comment.

The Bills did comment on it after their 21-0 Friday night loss to the Carolina Panthers, and head coach Sean McDermott really put his foot in it when he tried to express his feelings on the matter as much as legal matters would let him.

McDermott began his postgame press conference with a statement before handing things off to the media in attendance.

“Okay. I know there was a game just played, but I want to talk about something that’s more important, which is what we have going on with one of the members of our team right now. With Matt Araiza. It’s an extremely serious… just hard to go through. It’s not a situation that I or we take lightly whatsoever. It’s very serious. I understand the sensitivity of the situation, and it’s clear that we have work to do continue to figure this thing out here. And we’re going to do that.”

McDermott deflected questions about what he thinks makes Araiza a “great kid” as he has said, and he did not get into the details of the allegations, nor when the Bills actually knew about them.

“I can tell you this: My heart, and my thoughts and prayers, go out to the people involved,” McDermott then said. “And that includes Matt. It includes both sides here. The victim, and everyone involved. Our prayers go out to them.”

We are guessing that everybody in the Bills organization had a collective facepalm over that particular both-sidesing.

But now, the Bills are in need of a punter, the NFL is in need of yet another case of disinfectant after botching an alleged internal investigation, and that’s where we can mercifully leave this story in a football sense.

In a larger and far more important sense, one hopes for swift, fair, and accurate justice.

Bills release punter Matt Araiza amid rape allegations in civil lawsuit

Punter Matt Araiza has been released by the Buffalo Bills after he was accused in a gang-rape lawsuit.

The Buffalo Bills have released punter Matt Araiza amid a backlash of criticism after the rookie was accused in a gang-rape lawsuit this week. Adam Schefter was the first to report the news, and general manager Brandon Beane confirmed it during a press conference on Saturday.

On Thursday, Araiza was one of three football players named in a civil lawsuit that accuses them of raping a 17-year-old girl last year while they attended San Diego State.

In the initial wake of the lawsuit, the team released a statement that noted the organization “conducted a thorough examination” of the situation involving Araiza.

Reports indicate the team knew about a potential lawsuit as early as late July. Teams aconduct extensive background checks on potential draft picks. Araiza was a sixth-round selection by Buffalo in April’s draft.

On Friday, Buffalo visited the Carolina Panthers for their third and final preseason game of the year. Araiza made the trip but did not play. Backup quarterback Matt Barkley held punting duties.

While watching the contest from somewhere in Bank of America Stadium, Araiza released a statement claiming his innocence.

After the game, Buffalo head coach Sean McDermott answered a slew of questions relating to Araiza. He did not say much, however.

What McDermott did say is there is “work” to be done regarding the matter by the organization.

The most jarring comment was McDermott’s admission that there were new things he learned about the incident in the first 24 hours after the lawsuit’s announcement.

“There’s been some, and I’m not going to deny that,” McDermott said.

Without Araiza on the roster, the Bills currently do not have a punter. Only days prior to the bombshell report about the lawsuit, the team released incumbent punter Matt Haack. He went on to sign with the Indianapolis Colts.

Sean McDermott, Bills were unaware of Matt Araiza’s statement

Sean McDermott & the #Bills were unaware Matt Araiza was going to release a statement mid-game relating to the lawsuit he was named in:

The Buffalo Bills were not made aware that punter Matt Araiza was going to release a statement regarding the lawsuit that mentioned his name.

On Thursday, Araiza was one of three football players named in a civil lawsuit that accuses him of raping a 17-year-old girl last year while he attended San Diego State.

Things then got odd. On Friday, Buffalo visited the Carolina Panthers for their third and final preseason game of 2022. Araiza made the trip but did not play. Backup quarterback Matt Barkley held punting duties.

While watching the contest from somewhere in Bank of America Stadium, Araiza released a statement claiming his innocence. It went out via his legal representation to NFL media. It read:

“The facts of the incident are not what they are portrayed in the lawsuit or in the press. I look forward to quickly setting the record straight.”

Buffalo head coach Sean McDermott confirmed what some might expect. He did not know Araiza was going to do that.

“No,” McDermott said via video conference. “I’m aware of that statement since the game. I’m not going to comment on that.”

McDermott did not appear to be happy about the statement. He shook his head throughout his response.

Araiza was still going to fly back to Buffalo with the team following the game, per McDermott. The coach also called Araiza not suiting up his decision, calling it the “right thing to do.”

Sean McDermott: Bills have learned new details on Matt Araiza since lawsuit

A pretty large admission from Sean McDermott:

Buffalo Bills head coach Sean McDermott dropped one rather jarring line relating to the Matt Araiza lawsuit during his first press conference since the situation began.

The punter did not play against the Carolina Panthers in the team’s preseason finale on Friday. That comes a day after Araiza was one of three men named in a civil lawsuit that accuses him of raping a 17-year-old girl last year.

Following the contest, McDermott had to field a slew of questions regarding the matter. He did not want to address much, as one would expect.

But McDermott did pull the curtain back one time.

When the coach was asked if there were new things he learned in the past 24 hours regarding the allegation, he said yes.

“There’s been some and I’m not going to deny that,” McDermott said.

According to reports, the Bills knew about what was brewing in late July. Not to mention, NFL teams do massive deep dives on the background of every player they draft.

Evidently, it wasn’t large enough on Araiza.

The lawsuit claims the events took place in October 2021.

During the contest, Araiza also turned heads when he released a statement to reporters. He claimed his innocence:

“The facts of the incident are not what they are portrayed in the lawsuit or in the press. I look forward to quickly setting the record straight.”

McDermott still did not sound too happy as he also admitted he was not aware Araiza would do so.

Sean McDermott offered ‘thoughts and prayers’ to ‘both sides’ in Matt Araiza rape lawsuit

Bills head coach Sean McDermott addressed the rape charges against punter Matt Araiza in a way that made everything worse.

Sean McDermott is a very good head coach, and one of the better defensive minds of his era. He is also not in any way prepared to handle the kinds of questions he was inevitably going to get after the Bills’ 21-0 loss to the Carolina Panthers on Friday night. And a postgame press conference is not the ideal setting for what was about to happen.

McDermott knew that he was going to have to say more than what the team has said in the wake of a lawsuit filed in San Diego County Superior Court against Bills rookie punter Matt Araiza, and two other current and former San Diego State football players. The lawsuit, which was first reported by Colleen Shalby and Robert J. Lopez of the Los Angeles Times, accuses the three men of rape, false imprisonment and gender-violence crimes. An unidentified woman claims that Araiza, Zavier Leonard and Nowlin “Pa’a” Ewaliko took turns having non-consensual sex with her as she went in and out of consciousness. The woman was a 17-year-old high-school senior at the time.

Bills punter Matt Araiza one of three named in San Diego State gang-rape lawsuit

When asked if he is satisfied with the team’s organizational response, McDermott simply said, “We have work to do.”

As far as why Araiza didn’t play, McDermott said, “It was my decision. And at the end of the day, I didn’t feel like it was right.”

McDermott was obviously uncomfortable and emotionally affected by the entire situation. He did not comment as to whether Araiza would make final cuts.

While McDermott certainly wasn’t ready to answer for something of this magnitude, it does display a horrible lack of perspective to “both sides” this situation in any capacity. If Araiza did what he’s been accused of doing, he deserves very few thoughts and prayers of any kind. If he’s been falsely accused, that’s an entirely different matter. But both-sidesing this will not minimize the damage. And by allowing Araiza to travel with the team, but not play, the Bills as an organization risk looking like they don’t take it nearly as seriously as they say they do.

We already know that the Bills organization never reached out to the alleged victim, and barely talked with her attorney. We already knew that the Bills knew about the allegations before they cut punter Matt Haack last Monday, making Araiza the default punter on the roster. And we know that with Araiza out for the Panthers game, backup quarterback Matt Barkley had to punt against the Panthers. That Barkley somehow managed to average 40.0 yards per punt on his four punts is a cute story — we wrote about it — but we need to get back to how ill-equipped the Bills have been to handle any of this.

The statement released by the team on Thursday, after the story came out, now looks far too inadequate to cover such a serious subject.

The “through investigation” part seems particularly galling in light of all we now know.

Which, given how long the Bills have known about it, is completely and utterly inexcusable. And again, McDermott’s “both sides” comment, in which he appears to be giving equal weight to the feelings of an alleged rapist, and he invoked more than once… it’s difficult to know what to do with something like that.

The NFL has never been adept at handling situations involving any kind of violence against women. The NFL almost never reaches out to the victims in cases like this, and the NFL generally gives equal or more prominent weight to the statements of the alleged attackers than those of the alleged victims. That’s been proven through the years, and it was never more so than in the recent series of disasters involving Deshaun Watson. But this particular embarrassment could have been avoided with more careful wording.

It’s sad to say that, whether he thought so or not, Sean McDermott said the quiet part out loud.

WATCH: Bills head coach Sean McDermott fields series of questions on Matt Araiza

Every word #Bills head coach Sean McDermott had to say about Matt Araiza can be found right here:

Buffalo Bills head coach Sean McDermott spoke at a press conference following his team’s 21-0 loss to the Carolina Panthers in their third and final preseason game.

This one was not business as usual.

The  topic of the hour was punter Matt Araiza. The rookie sixth-round pick was named in a lawsuit on Thursday that accuses him of raping a 17-year-old girl last year while he attended San Diego State.

There was a long line of questioning for the coach on the subject. He did not want to address much, as one would expect.

What McDermott did say is there is “work” to be done regarding the matter by the organization.

The most-jarring comment was McDermott’s admission that there were new things he learned about the incident in the past 24 hours despite the team having been aware of the situation much earlier than this week.

“There’s been some and I’m not going to deny that,” McDermott said.
