Battery charges against UFC veteran Luis Pena dismissed

“Violent Bob Ross” Luis Pena had 18 months of court proceedings before his charges were dropped Thursday by a Florida judge.

Charges against former UFC fighter [autotag]Luis Pena[/autotag] stemming from an alleged domestic violence incident have been dismissed.

On Thursday, Broward County (Fla.) Judge Catalina Avalos ordered the two misdemeanor battery charges be dismissed, months after a previous nolle prosequi was not honored by the district attorney’s office.

Pena, 30, was arrested in October 2021 following an alleged domestic violence incident in which he was accused of striking his significant other and a witness who tried to break up the fight. Pena faced one charge of battery/touch or strike/cause bodily harm and one charge of battery. He was released from the UFC shortly after his arrest.

In an Instagram post, Pena touted the judge’s decision as a form of “justice.”

Best birthday present I ever got July 5th 2023, 2 years later the charges don’t get nolle pros they’re completely dismissed,” Pena wrote. “It’s unfortunate I lost so much over this injustice but it is what it is at this point, but it feels good to finally get some justice this is for all the people in my inbox and comments.”

Trial date delays

Since his arrest, Pena has faced dozens of court hearings. He pleaded not guilty to the charges in June 2022 and has maintained his innocence in social media posts.

The case was initially expected to reach trial last October but was shifted to November at the request of the prosecution. When the alleged victim repeatedly did not show up to the November trial date for work-related reasons, Judge Avalos ruled she must be present the following day.

When the alleged victim expressed continued unavailability, the prosecution and defense came to an agreement in recess: Pena would have to complete a 12-hour anger management course, and the case would be nolle pros (the prosecution would stop pursuing it).

Emergency motion filed

Seven days later, the state filed an emergency motion to withdraw the agreement after it screen-shotted an alleged Instagram post and comments from Pena directed at the alleged victim, also a combat sports fighter.

The screenshots showed comments from Pena in which he indicated purposely that he signed with bareknuckle boxing promotion BYB Extreme out of “pettiness” because the alleged victim was also under contract.

“Lol I just did it to be petty bro now she gotta see me,” Pena allegedly wrote in the comments. “But you won’t have to worry about that from me never was any conflict from my side in the first place.”

Final verdict

Despite the state’s attempt to withdraw the previous agreement, Avalos stayed firm that it must be honored after Pena held up his end. The state continued to request a withdrawal and argued Pena’s anger management certification was no longer valid because the program’s compliance officer, when presented with the social media posts, confirmed the behavior was not in line with their course.

Avalos saw things differently, however, and ruled the screenshots “unauthenticated” and “undated,” and added the exhibit “does not amount to competent evidence justifying the withdrawal of the State’s offer.”

Judge Avalos also deemed the agreement to be clear-cut and noted Pena quickly upheld his end. Citing precedent, the agreement at hand and Pena’s cooperation, Avalos denied the State’s motion to request to withdraw its plea offer and accepted a motion by Pena to dismiss the charges altogether.

Pena, 30, has fought in 10 professional combat sports bouts since his UFC release, according to his Tapology page. He most recently competed in MMA in April, a submission loss to Michael Dufort.

Former UFC fighter Luis Pena pleads not guilty to misdemeanor battery charges

Luis Pena pleads not guilty after an alleged altercation including his significant other and a witness in October.

Former UFC fighter [autotag]Luis Pena[/autotag] has pleaded not guilty to two misdemeanor battery charges.

According to a Broward County (Fla.) court document acquired by MMA Junkie, Pena officially gave a written plea Friday, along with a demand for discovery, information, and trial.

Pena, 28, faces one charge of “battery/touch or strike/cause bodily harm”and one charge of “battery,” stemming from an Oct. 9 arrest. According to police, Pena struck his significant other and a witness who tried to intervene in the tussle. The significant other suffered abrasions on her hand and wrist, as well as a bite mark on her knee, police said. The witness suffered an eye contusion and elbow laceration, police added. Pena was later released on bond.

Pena’s next court date is not listed in the court docket as of this story’s publication.

Shortly after his arrest, Broward County Sheriff’s Office gave MMA Junkie the following statement:

“On the above date and time, the above defendant was involved in a physical altercation with (redacted) whom he had been in an intimate relationship with for the last 1 1/2 years. The defendant did actually and intentionally strike (redacted) in the face multiple times with a closed fist and continued to strike (redacted) while she was on the ground. (redacted) had minor abrasions to the top of her left hand, abrasions on the left wrist, and an alleged bite mark to her left knee region. While the above incident was occurring, victim (redacted) observed the altercation and attempted to step in and defuse the situation between the Defendant and (redacted). At that time, the defendant struck (redacted) in the left eye with a closed fist. The aforementioned strike caused a purple contusion to the eye region of (redacted). When struck, (redacted) fell to the ground causing a laceration to her right elbow. (redacted) and (redacted) both provided sworn statements that attested to the above information, and BWC was in use and injuries were photographed.”

The identities of Pena’s significant other and witness were not revealed, as they are protected under Marsy’s Law, a constitutional amendment that provides victims and their families specific rights with the interest of fairness, respect, and privacy.

Three days after Pena’s October arrest, the UFC announced it released him from his promotional contract.

“This was a bad case and we knew that he had problems before that we were trying to help him with,” White told MMA Junkie and other reporters at the Dana White’s Contender Series 43 post-fight news conference. “This is a pretty nasty one. I don’t know if you guys read the police report, but yeah, this one had to happen.”

911 audio was released shortly after news of Pena’s arrest. A woman who identified herself as Pena’s girlfriend stated Pena hit her multiple times. She added there was already a “no contact” order in place.

Pena was arrested three times in 2021; once each in June, October, and November. Cases on charges from his June and November arrests were disposed, according to online records.

Since his promotional agreement termination, Pena has stayed actively competing, winning back-to-back fights under the Titan FC banner. He has alluded to his legal issues in Instagram stories, indicating he has proof the accused wrongdoings are untrue.

Ex-UFC fighter Luis Pena arrested again, faces two more misdemeanor charges including battery

Tuesday’s arrest marks the third time since June that Luis Pena has been arrested.

Former UFC fighter [autotag]Luis Pena[/autotag] was arrested Tuesday, marking his third publicly-known run-in with the law since June.

According to Broward County, Fla. online arrest records, Pena, 28, faces two new misdemeanor charges: battery and criminal mischief. TSN was first to report the news Wednesday.

Pena is being held at Paul Rein Detention Center in Pompano Beach, Fla. No bond has been set.

MMA Junkie has reached out to Broward County Sheriff’s Office for additional details but has not heard back at the time of publication. The story will be reflected with any updates should they come in at a later time.

In June, Pena was arrested in Coral Springs, Fla., on felony charges of robbery, battery and criminal mischief. The first charge stemming from the arrest is a misdemeanor battery charge with a bond amount of $1,000. The second is a misdemeanor domestic violence charge and does not have a bond amount listed because a bond hearing is required.

The second incident occurred Oct. 10. According to Broward County Sheriff’s office, “At approximately 12:34 a.m., Broward Sheriff’s Office Deerfield Beach deputies responded to a domestic disturbance call near the 200 block of Southeast 12th Avenue in Deerfield Beach. On scene, deputies made contact with multiple subjects, and Luis Antonio Peña was later detained and taken into custody. Peña was transported to BSO Main Jail and faces one count of simple battery and one count of domestic violence battery (both misdemeanor). The investigation continues.”

Following his second arrest, the UFC released Pena from his promotional contract just hours after the news broke.

“UFC is aware of the disturbing allegations concerning the recent arrest of Luis Pena,” the UFC said in a statement. “Mr. Pena has been open about his struggles with mental health and substance abuse issues and the organization has on multiple prior occasions attempted to help him get professional treatment. At this time, UFC believes Mr. Pena needs to deal with the health and legal issues in front of him, and consequently has informed Mr. Pena’s management that his promotional agreement has been terminated.”

Pena competed under the UFC banner seven times, winning four of those bouts, after entering the promotion following “The Ultimate Fighter 27” in 2018.

More details on Luis Pena have emerged in the form of 911 call audio that led to his recent arrest for domestic violence and battery.

TMZ.com obtained the 911 call audio made by a woman who said she was Pena’s girlfriend. At the start of the call, she identified him as being in the UFC and said he was using drugs or alcohol when he allegedly choked her and punched her.

“Well, I wasn’t trying to snitch,” the woman said on the call. “But since my boyfriend wants to be an asshole – he put his hands on me, and he’s got to go.”

When asked for more details by the 911 operator, the woman alleged Pena got physical with her two days prior, and then again just before she called for help from police.

“He punched me in the face,” she said. “But he did this also two days ago, I have the marks. I have a Band-Aid on my back. I have everything to prove it. So I would like the police to come and I want them to remove him so I can get my things and go the f*ck home.”

The woman also said the police were brought out another time prior to the call that led to Pena’s arrest – but that her refusal to give them more details meant they couldn’t do anything.

“(The police) were mad because I wouldn’t cooperate because I didn’t want to snitch on him,” she said. “But unfortunately, I have to now. So I would like them to come back.

“We have a no contact order, so technically we shouldn’t even be living together. I really need the cops to come and get him out now, because I have scratches and bruises all over me from him. I need him gone. I’m done, and I need help … please.”

This past Saturday, the former UFC lightweight was arrested in Deerfield Beach, Fla., on misdemeanor charges of domestic violence and simple battery. He was booked into the Broward County Jail in Fort Lauderdale.

According to the Broward Sheriff’s Office’s probable cause affidavit, the arresting officer said Pena struck the woman with a closed fist multiple times. He also allegedly hit a second woman who tried to stop him.

Pena bonded out of jail and signed an Order of Pretrial Release Conditions for domestic violence the day after his arrest. That order says he must stay 500 feet away from the alleged victim, her home and her place of employment at all times.

Pena, 28, last competed at UFC on ESPN 22 in April. The promotion released him from his contract Tuesday.

On Saturday, Pena was arrested in Deerfield Beach, Fla., on misdemeanor charges of domestic violence and simple battery. He was booked at the Broward County Jail in Fort Lauderdale.

Disturbing details about the incident were revealed when the full police report became available to the public. According to the arresting officer’s report, Pena struck his girlfriend and another woman repeatedly with a closed fist.

After learning the details about events surrounding the arrest, the UFC decided to terminate Pena’s contract. The promotion released a statement about the situation:

Pena is just one of a trio of fighters recently involved in similar situations.

“Something like that could happen to anybody,” White responded when asked if UFC Hall of Famer Jon Jones, who was also recently arrested following an alleged domestic violence incident in Las Vegas, could see similar repercussions. MMA legend Chuck Liddell was also recently arrested and jailed for an alleged domestic violence incident, although he no longer has ties with the promotion aside from being inducted into its Hall of Fame.

Police: UFC’s Luis Pena struck two women ‘with a closed fist’ in alleged domestic violence incident

The details surrounding UFC fighter Luis Pena’s arrest are disturbing.

Details have emerged surrounding [autotag]Luis Pena[/autotag]’s recent arrest in Florida.

On Saturday, the UFC lightweight was arrested in Deerfield Beach, Fla., on misdemeanor charges of domestic violence and simple battery. He was booked at the Broward County Jail in Fort Lauderdale.

The Broward Sheriff’s Office responded to MMA Junkie’s request for additional information and have provided the probable cause affidavit written by the arresting officer, Steven G. Lees.

The full statement reads:

“On the above date and time, the above defendant was involved in a physical altercation with (redacted) whom he had been in an intimate relationship with for the last 1 1/2 years. The defendant did actually and intentionally strike (redacted) in the face multiple times with a closed fist and continued to strike (redacted) while she was on the ground. The names of the two women that provided sworn statements have been redacted from the record in accordance with Marsy’s Law, a constitutional amendment that provides victims and their families specific rights with the interest of fairness, respect, and privacy.

Pena was held on a $6,000 bond for the two charges. He signed an Order of Pretrial Release Conditions for domestic violence on Oct. 10, the day after his arrest, which includes an order to “stay at least 500 feet away from the Complainant, the Complainant’s home, place of employment” at all times.

Pena, 28, last competed at UFC on ESPN 22 in April and does not currently have a fight scheduled. The promotion has not released a statement addressing the situation.

The first charge stemming from Saturday’s arrest is a felony battery charge with a bond amount of $1,000. The second is a felony domestic violence charge and does not have a bond amount listed because a bond hearing is required.

MMA Junkie requested additional information on Pena’s arrest, including a full police report, but has yet to receive further details.

On Friday, Pena posted a photo to his Instagram stories with girlfriend Jamie Driver, a fighter with six professional bouts who most recently competed in 2019.

The caption with the photo reads, “Y’all really thought it was over?”

It is unclear if Driver was the same woman involved in the incident in June, since that woman’s name was redacted from police reports and has not been made public. It also is unclear if Driver was involved in events surrounding Pena’s Saturday arrest.

UFC fighter Luis Pena arrested for robbery, battery, criminal mischief

UFC lightweight Luis Pena – “Violent Bob Ross” – was arrested in Florida on three felony charges.

It appears the next fight for UFC lightweight [autotag]Luis Pena[/autotag] may be in a court of law.

“Violent Bob Ross” was arrested Friday by police in Coral Springs, Fla., on felony charges alleging robbery by sudden snatching, battery and criminal mischief, according to online records. Pena (9-3 MMA, 5-3 UFC) was in custody at the Broward County (Fla.) Detention Center as Saturday afternoon.

“It was actually called in by another police department for us to go and get him, and then we had an independent person tell us where he was, and they took him into custody under that warrant,” Coral Springs police public information officer told MMA Fighting, which initially reported Pena’s arrest. “… Probably whoever called it in anonymously is involved in that case and wanted him to go to jail.”

No further details on Pena’s arrest were available at the time of publication.

Pena, 27, does not currently have a fight scheduled. He has not competed since an April victory over Alexander Munoz. Wednesday, the popular fighter sent out a tweet that indicated recent struggles with mental health issues.

“People aren’t comfortable talking about this, but I have been going through serious mental health issues my entire life and have finally gained the strength to get and accept the help I’ve needed for a long time,” Pena posted on Twitter. “If you’re struggling take it from me (it’s) okay to reach out”

Neither the UFC nor Pena’s team has issued a statement about his arrest.
