Judge denies Cain Velasquez bail in attempted murder case: ‘Risk is too great’

Former UFC champion Cain Velasquez will remain in custody. His next hearing is set for April 12.

Former UFC heavyweight champion [autotag]Cain Velasquez[/autotag] was denied bail Monday during his arraignment at the Santa Clara County Hall of Justice in San Jose, Calif.

After approximately 25 minutes of cases made by the two parties, Judge Shelyna Brown denied Velasquez bail. Judge Brown called his alleged actions “reckless” and stated “the risk is too great.” Velasquez will be due back in court April 12.

Velasquez, 39, was arrested Feb. 28 after allegedly shooting a man wile targeting another man, 43-year-old Harry Goularte, accused of molesting a family member possibly “100 times.”

Velasquez faces charges with attempted murder (one count), shooting at a motor vehicle or aircraft (one count), assault with a firearm (three counts), assault with a deadly weapon (three counts), willfully discharging a firearm from a vehicle (one count), and carrying a loaded firearm with intent to commit a felony (one count).

If found guilty of attempted murder, Velasquez faces a minimum of 20 years and up to life in prison, according to the California penal code. He faces additional time if found guilty of other counts.

The police report submitted by Detective Joel Martinez confirmed that  Goularte was recently charged with molesting a “close relative” of Velasquez and released from jail this past Friday. Velasquez had employed Patricia Goularte, Harry’s mother, as a daycare worker for the past two years.

Martinez said the investigation showed that police arrived at 3:14 p.m. to the scene of the shooting, which was reported to have taken place at multiple locations. When police arrived, they saw a Chevy Silverado. Three people were inside the vehicle, including Patricia Goularte, Harry Goularte and a man wounded by a gunfire, Paul Bender, who was taken to a nearby hospital.

The police investigation revealed that Velasquez rammed his Ford F250 into the side of the Silverado, in front of witnesses. He then followed the Silverado and fired two shots, one of which struck Bender in the arm. Five casings total were found at the scene. Velasquez was later identified by police as the shooter.

Velasquez was arrested without incident and a 40-caliber semi-automatic handgun was found in his vehicle. Two casings and ammunition were found in the vehicle.

“The sad tragedy is that Mr. Velasquez chose to take the law into his own hands, endangering the public and everyone in the truck,” Santa Clara County District Attorney Jeff Rosen said this past Wednesday. “This act of violence also causes more pain and suffering to his family.”

After Velasquez’s motive for his alleged actions came to light, many fighters and figures in the MMA community have rallied to support him on social media, with the hashtag #FreeCain gaining traction.

Velasquez stepped away from MMA competition following a February 2019 knockout loss to now-UFC heavyweight champion Francis Ngannou. He later pursued a stint in professional wrestling for WWE from 2019-2020. He most recently competed for Mexican wrestling promotion Lucha Libre AAA Worldwide.

Velasquez was arrested for allegedly shooting at a man accused of repeatedly molesting a close relative “100 times,” according to reports and court documents. The 39-year-old is facing a number of charges including attempted murder and assault with a deadly weapon.

Considering the potential motive of Velasquez’s actions, Rogan and Bisping agreed the former heavyweight champion was justified in his actions.

“It’s beyond sick,” Bisping said. “That guy deserves everything what Cain did. Well, Cain actually got his father, didn’t he? Not the guy himself, sadly.”

According to reports, Velasquez was chasing Harry Goularte and fired a gun several times at a truck carrying him, his mother, and stepfather. The stepfather was driving the vehicle and was the only person struck with a bullet during the incident.

“I mean, my only wish is that he did it with his hands,” Rogan said. “My only wish is that he just ran the car off the road, pulled that guy out of the f*cking car, and beat him to death. F*ck you.”

“And even that would have been too good for him,” Bisping added.

Velasquez is currently in custody at the Santa Clara County main jail where he awaits arraignment on Monday, when the judge could decide to set bail. If convicted of attempted murder, he faces a minimum of 20 years to life in prison, including additional time if found guilty of other charges.

According to a police report, Goularte, 43, was recently charged with molesting a “close relative” of Velaquez and was out on bail.

“That is a sickness,” Rogan said. “There’s like a certain sickness that people have, that human beings have, as sicknesses of the mind. But that one, the molesting a f*cking baby? … The molesting children is the sickest of all of those sicknesses.”

According to the San Jose (Calif.) Police Department’s “statement of facts,” Velasquez followed the parents of 43-year-old Harry Goularte from their San Martin home to Morgan Hill to pick up Goularte, who last week was arrested and harged with molesting a close underage relative of Velasquez, but was out on bail. After the parents picked up Goularte in their Chevy Silverado, Velasquez continued following them and shot into the vehicle.

At one point, Velasquez “was able to close the distance and ram the Silverado with his Ford” at in intersection before firing several shots at the vehicle with a .40 caliber pistol, according to the police report. Goularte’s stepfather was shot during the encounter.

The cell phone video, obtained by NBC Bay Area, appears to show Velasquez in an SUV chasing down a black truck with bullet holes and dents on the passenger’s side. The footage lasts about 10 seconds and offers a glimpse into what transpired.

More reported details have surfaced pertaining to the arrest of former UFC heavyweight champion [autotag]Cain Velasquez[/autotag], which took place in San Jose, Calif. on Monday.

According to a report Tuesday from The San Jose Mercury-News, Velasquez’s booking for attempted murder came after he allegedly shot at a car of three individuals – one of whom had recently been accused of molesting a close relative of Velasquez’s. The report cites court documents and additional sources.

While the alleged victim of sexual abuse’s identity is being withheld due to their status as a minor, the accused man is Harry Eugene Goularte, 43, who lives in San Martin, Calif. at a home-daycare business run by his mother.

Goularte was arraigned Friday on one felony count of “a lewd and lascivious act with a child under the age of 14.” He was released despite objections from the Santa Clara District Attorney’s Office.

The alleged shooting incident occurred three days later. The Mercury-News report mirrors tweets and comments put forth by Twitter user Fight Oracle and others, which stated Velasquez opened up fire on a car carrying Goularte but struck another individual. The individual hit was reportedly Goularte’s stepfather, who is expected to survive. The identity of the third individual is not known.

Velasquez, 39, is currently being held in Santa Clara County Main Jail without bail for attempted murder, with an arraignment scheduled for Wednesday at noon local time, per online records. Cain Velasquez was involved in a shooting that left one man injured with “non-life threatening injuries,” according to a report.

NBC Bay Area, citing “sources with direct knowledge of the investigation,” confirmed Velasquez’s involvement in Morgan Hill, Calif., although it’s unclear how he was involved. The San Jose Police Department is investigating the shooting and did not provide details regarding Velasquez.

The San Jose police media relations office tweeted that the injured man was shot “at least once” near the intersection of Monterey Highway and Bailey Avenue. He was “transported to a local hospital with non-life threatening injures.” One suspect was in police custody, but a motive was unknown. The shooting was reported at 3:14 p.m. local time, police said.

Velasquez, 39, trains at American Kickboxing Academy in San Jose, about 25 miles north of where the shooting happened. He was born in Salinas, roughly 40 miles south of Morgan Hill.

Velasquez hasn’t competed in MMA since a 26-second knockout loss to current heavyweight champion Francis Ngannou in February 2019. Since then he’s dabbled in professional wrestling with WWE, as well as in Mexico.
